These terms govern your use of the TrackChat Shopify app and its web dashboard at trackchat.in, provided by zSellr Enterprises LLP (“zSellr”, “we”, “us”), which publishes the app on the Shopify App Store. zSellr Enterprises LLP and zSellr (OPC) Private Limited (which operates the trackchat.in website) together form the zSellr group. By installing or using the app you agree to them. If you do not agree, do not install the app.
TrackChat is a Shopify app for merchants. It creates courier shipments and shipping labels, pushes tracking back to Shopify, sends order and support messages to your customers over WhatsApp and email, and provides related tools such as returns, tickets and reporting. Order-placed, cash-on-delivery confirmation and payment-received messages can be sent automatically, as can abandoned-cart reminders if you switch on cart-recovery autopilot; shipped, out-for-delivery and delivered updates are sent only when you tap send. It is not a payment service: your customers pay in your own Shopify checkout, and refunds are created in Shopify to the original payment method. Features may be added, changed or removed over time.
We grant you a non-exclusive, non-transferable, revocable right to use the app for your own Shopify store or stores for as long as these terms are in effect. You may not copy, resell, sublicense, reverse-engineer, or attempt to extract the source of the app, and you may not use it to build a competing product.
The app connects to services operated by others — Shopify, Meta (WhatsApp Business Cloud API), Delhivery, Blue Dart, Google and Zoho. You use those services under their own terms and pricing, using accounts and credentials you supply. We are not a party to those relationships and are not responsible for their availability, pricing, decisions, delivery outcomes, account suspensions, or the accuracy of the data they return. If a third-party service changes or withdraws its API, the related features of the app may stop working.
This section forms a data processing agreement between you and us and applies whenever the app processes personal data of your customers.
Roles. For your shoppers’ personal data you are the data controller (data fiduciary) and we are the data processor. You are responsible for having a lawful basis to send messages to your customers and for your own privacy notice. We process that data only on your documented instructions, which are the instructions you give through the app’s settings and actions.
Scope. We process your customers’ name, phone number, email address and shipping address, order contents and payment state, the content of WhatsApp and email conversations (including media they send), abandoned-checkout details and support tickets, solely to provide the app’s features: sending order notifications, confirming cash-on-delivery orders, creating courier shipments and labels, recovering abandoned carts, and handling returns and support. We do not sell personal data, and we do not use it to train models or for our own marketing.
Sub-processors. We use the providers named in our privacy policy — currently Shopify, Meta, Delhivery, Blue Dart, Google, Zoho, Railway and Cloudflare — each for the stated purpose. We will update that list, and notify you, at least 30 days before a new sub-processor handles your customers’ personal data.
Security. We apply the measures described in our security policy: encryption in transit, encryption at rest at the hosting layer, AES-256-GCM encryption of stored third-party credentials, shop-scoped access control, logging of staff access to customer data, and single-operator access to production systems.
Assistance. We support your obligations to your customers through the Shopify compliance webhooks: on a data request we locate everything we hold for that customer and, on your request, send you a copy; on a redaction request we delete or anonymise it; and when you uninstall we delete your store’s data. Chat and email history, courier address data and other short-lived records are also purged automatically once they pass our retention period, as described in the privacy policy.
Breach notification. If we become aware of a personal data breach affecting your customers’ data, we will notify you without undue delay and in any case within 72 hours of confirming it (and Shopify within 24 hours), with what we know about the scope and our remediation.
Deletion. On termination we delete your data as described above, except where we are required by law to retain it.
International transfers. Our providers may process data outside your country. We rely on the transfer mechanisms and commitments published by each provider.
TrackChat’s plans are sold through Shopify’s Managed Pricing. You choose a plan — including any free trial — on Shopify’s plan page (Plan & Billing in the app); charges are approved by you in Shopify, appear on your Shopify invoice and are subject to Shopify’s billing terms. Charges from third-party services — courier freight and WhatsApp conversation charges — are billed to you directly by those providers and are not collected by us. Refunds are handled under our Refund & cancellation policy; apart from that policy, and except where the law requires otherwise, fees already charged are non-refundable.
We aim to keep the app available and working, but we do not commit to any specific uptime or response time. The app may be unavailable during maintenance or because of a failure at Shopify or another provider. Support is available at info@trackchat.in.
The app is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be error-free or uninterrupted, that every message will be delivered, that AI-generated text will be accurate, or that a shipment will be picked up or delivered by a courier.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for lost profits, lost sales, lost data, or loss of goodwill, arising from your use of or inability to use the app. Our total aggregate liability for all claims relating to the app is limited to the amount you paid us for the app in the three months before the event giving rise to the claim, or ₹5,000, whichever is greater.
You will indemnify us against claims, damages and costs arising from your misuse of the app, from messages you send through it, or from your breach of these terms or of applicable law.
You may stop using the app at any time by uninstalling it from your Shopify admin, which also ends your subscription. We may suspend or terminate access if you breach these terms, if required by Shopify or by law, or if we discontinue the app. On uninstall your access token is deleted immediately and, when Shopify sends its shop-redaction request about 48 hours later, your store data is deleted as described in our Privacy Policy. Export anything you need before uninstalling.
We may update these terms as the app changes. The “Last updated ” date above reflects the current version, and continued use of the app after an update means you accept it.
